Tioga Street, Ithaca, NY 14850, on May 15, 2026, at 9:30 am or as soon thereafter as counsel may be heard, for a judgment pursuant to CPLR Article 78. For the aforementioned reasons, Petitioner respectfully requests that this court: (a) pursuant to CPLR § 3001 declare that Cornell University misapplied its relevant policies against John Doe, acted in an arbitrary and capricious manner and that its decision against John Doe should be annulled; (b) vacate of any and all penalties imposed on John Doe with respect to this matter and the expungement of all references to the underlying charges contained in his academic record; and (c) order such other and further relief that the court deems just and proper.
