PLEASE TAKE NOTICE, that upon the annexed Verified Petition of John Doe sworn to on March 
30, 2026, the Affirmation of Alan E. Sash dated March 30, 2026, together with the exhibits annexed thereto, 
an application will be made to the term of this Court, to be held at the Courthouse located at 320 N. Tioga 
Street, Ithaca, NY 14850, on May 15, 2026, at 9:30 am or as soon thereafter as counsel may be heard, for a 
judgment pursuant to CPLR Article 78. 
For the aforementioned reasons, Petitioner respectfully requests that this court:  
(a) pursuant to CPLR § 3001 declare that Cornell University misapplied its relevant policies against 
John Doe, acted in an arbitrary and capricious manner and that its decision against John Doe should be 
annulled;  
(b) vacate of any and all penalties imposed on John Doe with respect to this matter and the 
expungement of all references to the underlying charges contained in his academic record; and  
(c) order such other and further relief that the court deems just and proper.
