Farrell Acting Supreme Court Justice Supreme Court of the State of New York Sullivan Supreme and County Courthouse 414 Broadway Monticello, NY 12701 (via NYSCEF and e-mail) Re: Lopes, Gillio v. Hochul, et. al Supreme Court, Albany County Index No. 911974-26 Dear Justice Farrell: This office represents Respondents Kathleen M. Hochul, Governor of the State of New York and Letitia James, Attorney General of the State of New York (collectively, Respondents) in the above-referenced matter. I write today to respectfully request permission to file a memorandum of law in opposition to the verified petition and in support of Respondents’ answer of up to 12,000 words. CPLR 7804(f) permits Respondents to assert their objections in point of law as a motion to dismiss or in their answer. Pursuant to 22 NYCRR § 202.8-b and this Court’s rules, the accompanying memorandum of law for both a motion to dismiss and an answer “shall be limited to 7,000 words . . . .” As permitted by CPLR 7804(f), Respondents intend to include their objections in point of law with their answer. Although CPLR 7804(f) would otherwise permit Respondents to initially move to dismiss supported by a 7,000 word memorandum of law, and then, if necessary, answer, also supported by a 7,000 word memorandum of law, Respondents intend to proceed with a single submission in the interest of expedience. To adequately address both their objections in point of law, as well as the merits of Petitioner’s application, Respondents require additional words. INDEX NO. 911974-26 NYSCEF DOC.
